Connecticut Car Accident Lawsuit Filed Against State Lawmaker

Posted on April 15, 2013 by Keith Adkins

April 15, 2013

A Connecticut Car Accident Lawsuit was filed last week in state Superior Court against a prominent state lawmaker. Reports indicate the lawsuit alleges the lawmaker’s negligence in getting behind the wheel of her vehicle after consuming alcohol was directly responsible for causing an accident that left another woman seriously injured.

The crash happened on August 15 of last year at the intersection of North and Briarwood Avenues. The legislator was driving a Nissan Sentra, carrying two other passengers, from a party at a restaurant. As she began to pass through the intersection though, authorities determined she failed to yield for a traffic signal and collided with a 2002 Honda Accord.

The impact of the collision left the driver of the Honda with back and brain injuries that have accumulated to almost $11,000 in medical expenses. Now according to Ct Latino News, the victim has filed suit alleging the lawmaker’s intoxication at the time of the accident was directly responsible for the collision occurring. Furthermore, she is considering filing suit against the restaurant that allegedly over-served the woman and it’s owner under the state’s Dram Shop Act.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers are aware of how devastating an accident with a drunken driver can be. That’s why the firm is hopeful a decision in the case will bring the victim a sense of closure to the incident.

Bridgeport Motorcycle Accident Prompts Resident’s Safety Concerns

Posted on April 12, 2013 by Keith Adkins

April 12, 2013

A 30-year-old man was killed as a result of a Bridgeport Motorcycle Accident that occurred this past weekend. Reports indicate the crash happened on Sunday along Boston Avenue, near the intersection with Orchard Street.

According to an article published in a recent issue of The Connecticut Post, the victim was riding his bike along Boston Avenue with a fellow motorcyclist. As the pair began to pass through the intersection with Orchard though, a pickup truck failed to yield the right-of-way to the bikers and struck the victim’s motorcycle. The impact of the collision caused the motorcyclist to be thrown from his machine. He struck his head on a rock upon landing and was declared dead at the scene as a result of his injuries.

A spokesman for the Bridgeport Police Department, William Kaempffer, explained that detectives are still looking into what contributing factors may have played a part in the crash.

The accident has left many area residents concerned over safety along the roads, prompting some to call for a traffic light to be installed at the accident’s location.

While remedies to the problem, such as traffic signals, may only come to fruition in the future, the Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers say there are precautions motorcyclists can take to help prevent injuries or death in the event of a collision. The firm says it’s important for motorcyclists to wear a helmet and other protective gear every time they go for a ride.

How do you investigate a medication error case?

Posted on April 11, 2013 by Jerry Mcenery

How do you investigate a medication error case?

Our Connecticut Drug Injury Lawyers obtain medication records from your doctors, hospital and pharmacy to see what documentation exists of the error. We look for incident reports of the mistake, and other documentation of what happened. In hospital and nursing home records, we evaluate the doctors’ orders, the medication administration records, narrative notes and records of drug allergies to see if a mistake was made.

I had a bad reaction to a medicine that was given to me and I almost died. Could this be a case?

Medication error cases are like medical malpractice cases, so you need to have a deviation from the standard of care (a mistake) which causes serious permanent harm, to have a successful case.  If this was the first time you received the medication, then it is likely impossible to prove a mistake was made, and if you have recovered, then there is no permanent harm.  But if you experienced a serious reaction, your case should be evaluated by an attorney familiar with medication errors, and we evaluate many such claims.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers acknowledge the dangers medication errors can present and suggest discussing your legal rights with an attorney if you have been harmed by a medication given to you by a health care professional.

Employee Loses Arm In Connecticut Workplace Accident

Posted on April 10, 2013 by Keith Adkins

April 10, 2013

One of the most common accidents that result in an employee needing to file a claim for Connecticut Workers’ Compensation Benefits is when an individual comes into contact with an object or equipment on a job site  In fact, the Bureau of Labor Statistics estimates these incidents account for roughly 15 percent of all workplace fatalities.

Such an accident was responsible for leaving a 20-year-old man with a severed arm in Hamden, Connecticut, earlier this week. According to a story from NBC-Connecticut, the incident occurred at around 11:15 a.m. at the Modern Material facility on State Street. The victim was working with a piece of equipment that sifts topsoil when his arm became stuck in a conveyor belt. The man’s appendage was severed from his body before his co-workers were able to stop the machine and free him.

Paramedics rushed to the scene and transported the injured worker to a local trauma center, where he remains hospitalized.

Investigators from the Occupational Safety and Health Administration have been called to the scene to determine what may have caused the accident and if it could have been prevented.

The Waterbury Personal Injury Attorneys with Carter Mario Injury Lawyers recognize the dangers many workers face each day on the job. The firm may be able to help if your have been injured in a workplace accident that occurred at no fault of your own.

If an ambulance takes a long time to arrive, is that negligence?

Posted on April 9, 2013 by Sean Hamill

The ambulance took 20 minutes to get here. Is that negligence?

It could be, but many factors need to be evaluated, including the location of the emergency, routing of 9-1-1 calls, and which service is responsible to respond to 9-1-1 calls.

To investigate this type of claim, our Connecticut Auto Accident Lawyers obtain timed recordings of 911 calls; evaluate 911 service areas; first responder assignments; and travel routes.

The ambulance crashed with a car while I was in it causing even worse injury. Can I file a claim for this accident?

Yes. You should be compensated for the injuries caused by the collision. Depending on who was at fault for the accident, you could recover from either the ambulance company or the driver of the other vehicle.
The Connecticut Auto Accident Attorneys with Carter Mario Injury Lawyers wish anyone injured in an accident a speedy recovery; and ask that motorists do their part to keep one another safe by always watching out for ambulances as they approach.

Winners Of The DMV Safety Video Contest Announced

Posted on April 8, 2013 by Keith Adkins

April 8, 2013

The winners of the Connecticut Department of Motor Vehicles’ (DMV) video contest have been announced. An article from the West Hartford Patch explained how three teams from a local high school had placed in the top ten entries to the contest.

More than 500 were submitted to this year’s “From the Driver’s Seat to the Director’s Chair” contest. Participants were asked to create a public service announcement that educates the public on the importance of driving safely. The aim of the contest is to reduce the number of Connecticut Car Accidents involving teens.

Willimantic’s Arts at the Capitol Theatre took first place in the contest, which consisted of a $5,000 grand prize. Second place was awarded to a Madison local. He was given a $4,000 consolation prize.

The graphic design and photography classes from Halls High School garnished quite a bit of the days attention though, taking third, fourth, and fifth place prizes. Their placement in the contest yielded participants a total of $6,000 in prizes.

A panel of judges, who included the state Governor and Attorney General, as well as several business executives and highway safety advocates selected the winners. The contest was funded by a $15,000 donation from the Travelers “Claims U” facility in Windsor, Connecticut.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers hold a similar contest each year that gives a $2,000 scholarship to 10 winning participants. The firm encourages students to look into the contest and consider entering.

Federal Officials Considering Cuts To Veterans’ Disability Benefits

Posted on April 5, 2013 by Keith Adkins

April 5, 2013

With the nation’s debt swelling, federal officials are considering making adjustments to the way funds from programs like Veteran’s Disability Benefits are distributed in order to cut costs. Many are opposed to the changes though, saying those who have been injured while serving their country have sacrificed enough already.

An article published by The Day explained the President has proposed creating an alternative method for calculating inflation of the nation’s currency, which is used to determine increases in disability payments. Under the proposed changes, the amount of benefits an individual receives still grows with the cost of living, but at a much slower rate.

With the way Cost of Living Adjustments (COLAs) are currently calculated, disability payments increased by 1.7 percent this past year. Under the new proposed calculation method, payments would have only increased 1.4 percent. Estimates show the strategy will save the nation roughly $340 Billion over the next ten years.

These savings will come at the cost though of those who have already sacrificed the most. Raymond Kelly, legislative director for Veterans of Foreign Wars, pointed out that a soldier with a 100 percent disability who begins receiving benefits at 30-years-old would have seen their payments cut by $2,300 annually by age 55 under the new rules.

The Hartford Personal Injury Lawyers with Carter Mario Injury Lawyers recognize how complex the laws regulating disability benefits can be for veterans. That’s why the firm is here to answer any questions about your legal rights.

Connecticut Town Considers Paying Settlement in $3.5 Million Wrongful Death Lawsuit

Posted on April 3, 2013 by Keith Adkins

April 3, 2013

The family of a 33-year-old man, who was killed during a police raid by members of the Darien Police Department, has filed a $3.5 million Connecticut Wrongful Death Lawsuit in connection to their loss. Now, the town of Darien is considering paying the family $437,500 as their part of a settlement in the matter.

According to an article from the Darien Patch, law enforcement from five different departments in the region conducted a raid on a residence. During the course of the operation though, officers shot the victim a total of six times.

The family’s suit claimed the negligence of members from the Southwest Regional Emergency Response Team and the cities that hired them were directly responsible for the loss of their loved one.

Now rather than face the costs associated with fighting the case, The Board of Selectmen from Darien are considering the settlement that would eliminate the town from facing any liability in the matter. Officials say that if the terms of the settlement were agreed upon, the town’s insurer, and not taxpayers, would pay the money.

The owner of the home where the raid occurred is also seeking damages in the matter.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers hope a decision in the case will help bring a sense of closure to the incident for the family of the victim.

Connecticut Hospitals Working To Eliminate Alarm Fatigue

Posted on April 1, 2013 by Keith Adkins

April 1, 2013

While alarms on equipment in hospitals are aimed at protecting patient safety, new data suggests they may have the opposite effect. The Connecticut Post recently discussed this problem and what hospitals in the region are doing to solve it.

Data from the Department of Public Health showed that a growing number of alarms used on equipment like heart rate monitors and ventilators, and the subsequent false alarms, had desensitized hospital staff to the sound. This, in turn, resulted in slower response times by nurses and staff.

This “alarm fatigue” resulted in a total of 216 deaths nationwide over a five-year period. Such errors have also led to accidents that have resulted in some patients filing a Medical Malpractice Lawsuit.

Despite these risks, experts say the alarms are needed. So, to help eliminate the problem, many hospitals in Connecticut have begun to adopt programs aimed at better educating hospital staff. For instance, the Hospital of Central Connecticut has adopted several checklists staff must run through in the event of an alarm, while the Bridgeport Hospital has implemented the use of “talking bed rails” to better protect patients who may be at risk of a slip and fall accident.

Carter Mario Injury Lawyers and their team of Connecticut Personal Injury Attorneys are hopeful the efforts being made at medical facilities in the state will better protect patients from slow responses by hospital staff to equipment alarms.

Medical Malpractice Claims Involving Children

Posted on March 28, 2013 by Cristina Lopez

My child had surgery and did not get the result I was expecting. How much time do I have to bring a malpractice case for injury to my child?

In Connecticut Medical Malpractice cases, you have two years from the date of the injury to bring a claim. There are few exceptions, and generally there are no exceptions for children, even those injured at birth. This allows very little time to collect medical records and get the case properly evaluated so it is important to contact us immediately if you believe you have a malpractice case.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers believe that doctors and medical staff have a responsibility to protect the well-being of patients. Failure to do so could be considered negligent, and anyone who has suffered because of such a mistake is encouraged by the firm to explore their legal rights.
