Can I make a claim if someone fled the scene?

Posted on May 23, 2013 by Sean Hamill

We wanted to share a question we were asked on the phone recently by a new client. They weren’t sure if they had a Connecticut Auto Accident case if they couldn’t prove who hit them.

I was crossing the street and got hit by an SUV which left the scene. Now there is no way to find out who hit me. Is there any way I can make a claim?

You may be covered by your own auto insurance policy, or if you are a member of a household in which another family member has auto insurance, you may be covered by that policy.  These are difficult cases sometimes involving questions of insurance contract language, and we can help you to find out if you are covered for your injuries.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers urge drivers to always make safety a top priority when behind the wheel of a car. This goal can be achieved by simply buckling up, slowing down, and always driving defensively.

Connecticut Train Accident Leaves More Than 70 People Injured

Posted on May 22, 2013 by Keith Adkins

May 22, 2013

Investigators with the National Transportation Safety Board (NTSB) have stated that a faulty rail may have been responsible for causing a Connecticut Train Accident that left dozens of passengers seriously injured. Reports indicate the crash happened this past Friday evening, just after 6:00 p.m. on a stretch of track between the Bridgeport and Fairfield stations.

According to a story released by CNN News, a Metro-North train that was heading east along a set of tracks derailed. Due to the train’s speed at the time of the derailment, several cars skid into the path of another train that was carrying passengers in the opposite direction.

The impact of the collision left more than 70 people injured. Three were hospitalized in critical condition, while another nine remained in serious condition.

An investigation that was launched into the crash by the NTSB found that a piece of track was broken and have stated it may have been a contributing factor in the crash. Officials stated further laboratory analysis would have to be performed in order to conclusively determine the broken track was the cause of the crash.

In the meantime, numerous passengers are left facing extended recovery times from injuries suffered during the crash. These injuries could leave many unable to work and with mounting medical bills.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers acknowledge the difficulties being injured in such an accident can pose. The firm is here to help those who were hurt as a result of this tragic accident.

Colon Cleansing Dangers Exposed By Researchers

Posted on May 20, 2013 by Keith Adkins

May 20, 2013

While some are touting colon cleansing -otherwise known as colonic irrigation or colon hydrotherapy- as a new way of clearing the body of toxins and other wastes, others are calling it a serious danger to one’s health.

Ranit Mishori, MD, MHS, has spent much of his career studying Colon Cleansing Dangers and two years ago, released a study showing there were no significant health benefits to the procedure. Furthermore, he explained that there were several significant health risks involved in the procedure.

The procedure involves a patient having up to 60 liters of liquid containing certain cleansing substances pumped into the colon through a tube that is inserted into the rectum. The sheer volume of liquid that is used has been known to cause some patients to experience injuries such as:

  • Bowel Perforation
  • Severe Dehydration
  • Sepsis (Infection)
  • Death

An article from Gastroenterology & Endoscopy News explained that due to these risks, many experts have called for the government to take action in order to prevent the procedure from being performed. For example, researchers have called for the FDA not to approve the devices that are used to preform colon cleansing procedures. Furthermore, they advise medical professionals against preforming the procedure.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers recognize the risks involved with having this particular medical procedure performed. The firm may be able to help a person who has suffered serious injuries as a result of colon cleansing.

Connecticut Begins Enforcement Campaign To Reduce Fatal Car Accidents

Posted on May 17, 2013 by Keith Adkins

May 17, 2013

Both drinking and driving and a lack of seat belt use are major contributing factors to fatal Connecticut Car Accidents. In fact, data shows these two behaviors account for hundreds of lives being lost on the state’s roadways each year.

In order to combat the problem, officials with the Waterford Police Department have announced they will be conducting an enforcement campaign beginning this weekend and running through the end of Memorial Day weekend.

An article from The Waterford Patch explained that during that time period, there will be two to three extra officers placed on each patrol shift that have been given the specific assignment of targeting those who are suspected of being under the influence or who are not properly restrained by a seatbelt under a zero tolerance policy. Those who are caught drinking and driving will be placed under arrest, while those who are not wearing their seatbelt will be issued a citation.

It is important for parents and caretakers of children to remember that vehicle restraint laws also apply to children. State law requires that all children must be restrained in an approved child restraint system until the age of 6-years-old or the child is 60 pounds.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers applaud the efforts that are being made to keep the state’s highways safe. The firm is hopeful the campaign is a success in reducing fatal accidents!

New Britain Man Killed In Motorcycle Accident

Posted on May 15, 2013 by Keith Adkins

May 15, 2013

A 43-year-old man from New Britain died as a result of a Connecticut Motorcycle Accident that occurred last week. Reports indicate the fatal crash happened Friday morning along Route 9, near Exit 25.

A story from NBC-Connecticut explained the victim was traveling northwest along the road when a Honda Civic, being driven by a 53-year-old man, from Bristol, Connecticut, struck the motorcycle. The bike’s operator then lost control of the machine and collided with two other vehicles traveling along the highway.

The victim sustained massive injuries due to the fact that he was not wearing a helmet at the time of the collision. He was transported to a local hospital, but died as a result of his injuries a short time later.

The accident comes on the heels of a debate being sparked among state lawmakers in regards to reform of Connecticut’s helmet laws. Current regulations require that only riders who are younger than the age of 18-years-old to be required to wear a DOT-approved helmet. Some lawmakers have called for requiring all riders to wear a helmet, considering studies have shown the single piece of equipment can drastically slash a rider’s chances of death in the event of an accident.

The Connecticut Personal Injury Lawyers with Carter Mario Injury Lawyers encourage motorcyclists to not only always wear a helmet, but other pieces of safety equipment such as eye protection, a leather jacket, gloves, and sturdy boots.

OSHA Fines Connecticut Company $6,000 For Workplace Safety Violations

Posted on May 13, 2013 by Keith Adkins

May 13, 2013

The Occupational Safety and Health Administration has issued citations in the amount of more than $6,000 to a Connecticut company for their part in a workplace accident that left an employee seriously injured.

According to an article published in The Connecticut Post, the victim was part of a crew using a skip hoist to move concrete at the New Milford Block and Supply Corp. facility in February. While moving the blocks of concrete, the victim’s hand became entangled in a wire rope and eight of his fingers were severed.

OSHA immediately launched an investigation and found the company responsible for committing three “serious” safety violations, including not having a safeguard in place to cover the exposed wire rope that was responsible for causing the victim’s amputation.

The company was originally fined approximately $10,000, but the number was lowered in a settlement that was reached between OSHA officials and the company.

The incident leaves many workers curious as to how expenses, such as medical bills and lost wages, are covered in the event of a workplace accident. Carter Mario Injury Lawyers and their team of Connecticut Personal Injury Lawyers explain several options are available to injured workers.

The most common way to be reimbursed for these expenses is to file for Workers’ Compensation Benefits; however, the process for approval can be quite complex. That’s why the firm suggests discussing your legal rights with an attorney if you are considering applying for these benefits.

Connecticut Explosion Leaves One Worker With Fire and Burn Injuries

Posted on May 10, 2013 by Keith Adkins

May 10, 2013

An employee of a Sterling, Connecticut, explosives company was left with serious Fire and Burn Injuries as a result of an accidental blast that occurred at the facility earlier this morning. Reports indicate the blast happened at Austin Powder, located on Ekonk Hill Road.

According to a story from NBC-Connecticut, a spokesperson from the Department of Energy and Environmental Protection explained they believe the blast was caused by a chemical reaction and resulted in one worker suffering chemical burns. First responders rushed the victim to a local trauma center to receive further treatment.

Since the explosion occurred, a number of officials from different government agencies have responded to the blast site in order to begin conducting investigations into the incident.

The blast highlights the dangers so many workers face each day as a result of fires and explosions while on the job. In fact, the Bureau of Labor Statistics estimates that fires and explosions were responsible for causing a total of three percent of all workplace fatalities that occurred in 2011.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers are aware of how devastating the injuries caused by such a blast can be, not only to the victim, but their family as well. The firm is here to help anyone who has suffered a fire and burn injury that was not their fault.

Victims of Connecticut Truck Accident Awarded $15.7 Million In Compensation

Posted on May 8, 2013 by Keith Adkins

May 8, 2013

A Hartford jury recently found a trucking company is responsible for a Connecticut Truck Accident that resulted in two deaths and left three others seriously injured. Reports indicate the company has been ordered to pay the victims, and the families of those that died, a total of $15.7 million.

A story published by the Connecticut Law Tribune explained that the crash happened on November 2, 2007, near the I-95/I-395 interchange in East Lyme, Connecticut. Witnesses stated that the tractor-trailer that was involved was traveling along the northbound lanes at roughly 80 MPH when it struck a guardrail and rolled into the median. As the truck skid to a halt, it collided with five other vehicles.

The impact of the collision killed both the driver of the truck and another motorist. Three others involved in the collision suffered injuries ranging from broken bones to Post-Traumatic Stress Disorder (PTSD).

The victims sued the trucking company, claiming the truck’s braking system was faulty and the vehicle should have never been in service. A jury agreed and awarded the victims compensation ranging between $1,069,500 and $5,575,000 each. The company that owned one of the vehicles involved in the crash was also awarded $50,000 for their losses.

The Hartford Personal Injury Lawyers with Carter Mario Injury Lawyers are hopeful the decision that was reached in the case will bring a sense of closure to the tragedy for the victims and their families.

Connecticut Lawmakers Consider Reporting Distracted Driving To Insurers

Posted on May 6, 2013 by Keith Adkins

May 6, 2013

With a growing number of Connecticut Car Accidents being attributed to distracted driving in recent years, state legislators adopted a law that banned motorists from texting and driving. So far though, the law has proven to be ineffective in getting people to put their phones down while driving.

Now, lawmakers are taking another approach towards solving the problem by considering a regulation that would report anyone who is caught breaking the texting and driving ban to their insurer. The hope is that hitting motorists where it sometimes hurts the most, their pocketbook, will help to reduce instances of distracted driving in the state.

An article from NBC-Connecticut stated that insurance companies could then use the information to increase rates for drivers who engage in the risky behavior. Current law just requires a driver to pay a fine and the infraction is never reported to their insurance company.

The bill, which is under consideration in the state House of Representatives, would achieve this by making any distracted driving infraction one of the many moving violations that is open to review by insurance companies. The bill would also increase fines for an infraction from between $125 to $300, to anywhere from $150 to $400.

The Connecticut Personal Injury Attorneys with Carter Mario Injury Lawyers applaud the efforts being made to improve highway safety in the state through any means necessary!
